Copyright notice & DMCA
This page explains what the Site publishes, who receives copyright notices, what a notice must contain, and what happens after it arrives. It also sets out the counter-notice route and the policy on repeat infringers.
1. What this site actually publishes
The public pages of powersport.one publish document metadata (title, brand, model, year, document type, language, page count), short written summaries, and extracted numeric facts such as torque values, fluid capacities, spark plug gaps and service intervals. The Site does not reproduce the text of the manuals, and the Site does not host PDF files on its public pages.
The PDF files themselves are kept in a closed storage area. They are delivered only through the Telegram bot @powersports_manuals_bot, after payment and after access has been granted, as a private one-to-one transfer.
The archive contains a mixture of documents produced by manufacturers as OEM material and copies obtained from public third-party sources, including the powersport.one FTP library. The Operator keeps an index of what the archive holds, and acts on complaints about it under the procedure below.
2. Designated agent
The Operator of powersport.one has designated its project owner as the agent for the receipt of copyright infringement notices concerning the Site, the archive and the files delivered through the bot. Notices are handled by that agent.
3. How to send a notice
Send a Telegram message to @yitshock with the subject line “DMCA notice”. A notice that is missing any of the elements below cannot be acted on, so please include all six:
- Signature A physical or electronic signature of the copyright owner, or of a person authorised to act on the owner’s behalf.
- Identification of the copyrighted work Identification of the work claimed to have been infringed. If a single notice covers several works, a representative list of those works.
- Identification of the material claimed to be infringing Information reasonably sufficient to locate it: the catalogue URL, the catalogue entry title, brand, model and year, or the file name and catalogue entry of the file received through the bot.
- Contact information Your name, company name if any, postal address, telephone number and e-mail address, so that the Operator can reach you.
- Good-faith statement A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy and authority statement A statement that the information in the notice is accurate, and that you are the copyright owner or are authorised to act on the owner’s behalf.
A person who knowingly and materially misrepresents that material is infringing, or that its removal was a result of mistake or misidentification, may be liable for damages under 17 U.S.C. § 512(f). Please set out the facts as they are. Notices that are withdrawn, unproven or knowingly false are not acted on.
4. What happens after a notice arrives
- Acknowledgement The Operator acknowledges receipt, normally within 2 business days.
- Review The notice is checked against the archive index to identify the material and the rights claimed over it.
- Response A written response is sent within 5 business days of receipt, stating one of: the material has been removed from the archive, or access to it has been restricted; the material has been referred to its source for verification; or the notice cannot be acted on, with the reason. Where material is removed, it is also removed from the search index and from the catalogue.
If the same document is delivered to users who purchased it before removal, the Operator will decide case by case whether a refund under Section 4.4 of the Terms of Service is appropriate, and will say so in the response.
5. Counter-notice
If you believe that material was removed by mistake or misidentification, you may send a counter-notice to the same contact, with the subject line “Counter-notice”. It must contain:
- Signature A physical or electronic signature of the subscriber.
- Identification of the removed material A description of the material that was removed, and the place where it appeared before removal — the catalogue entry, URL or file name.
- Statement under penalty of perjury A statement that the subscriber has a good-faith belief that the material was removed as a result of mistake or misidentification.
- Contact details Name, postal address, telephone number and e-mail address.
- Consent to jurisdiction A statement that the subscriber consents to the jurisdiction of the federal court (or, where the subscriber is outside the United States, of any court in the jurisdiction where the Operator is located), and that the subscriber will accept service of process from the person who sent the original notice.
Where a valid counter-notice is received, the Operator forwards it to the person who sent the original notice. If that person does not notify the Operator within 10 business days that a court action has been filed to restrain the activity, the Operator may restore the removed material. If it is restored, it reappears in the archive and in the search results.
6. Repeat infringers
In line with the repeat-infringer policy, access may be limited for users who are the subject of three or more substantiated infringement notices, and for users who are repeat infringers within the meaning of the law. Access may be limited on that basis without a refund for the affected files. A first notice is always handled as a notice, not as a warning.
7. Files delivered through the bot
A claim about a file that was delivered through the bot is handled exactly like a claim about anything else in the archive. Give the catalogue entry or the file name, and the Operator locates the file in the storage area, checks the claim, and, where it is substantiated, removes the file from the archive and from the index. A removal affects the catalogue entry and the search results for that document.
8. Contact
Telegram is the channel for notices: @yitshock, subject line “DMCA notice”. Please write in English, include all six elements, and keep the thread open for follow-up questions — a notice without a reachable contact cannot be processed.
